1. Agreement to Terms

By accessing or using SiteStable ("Service," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

2. Description of Service

SiteStable provides website uptime monitoring services, including traditional HTTP monitoring and synthetic monitoring with AI-assisted setup. We monitor your websites and alert you when they go down or experience issues.

  • HTTP Monitoring: Checks if your website URLs are accessible and returning correct status codes.
  • Synthetic Monitoring: Uses artificial intelligence during initial setup to identify critical interactive elements (buttons, forms, checkout flows), then continuously monitors those elements with headless browser checks to detect broken functionality even when your site appears "up."

Service Tiers:

  • Free Tier: Monitor 1 website with up to 10 HTTP monitors and 1 synthetic monitor. Checks every 3 minutes. Data retention for 6 months.
  • Pro Tier: Coming soon. Will offer 3 websites, unlimited HTTP monitors, 3 synthetic monitors, faster check intervals, and extended data retention.

3. Account Registration

To use the Service, you must:

  • Provide accurate, current, and complete information during registration (email address and name required)
  • Verify your email address within 24 hours
  • Maintain the security of your password
  • Be at least 13 years of age
  • Not create multiple accounts to circumvent service limits (we collect IP addresses during registration for fraud detection)
  • Complete reCAPTCHA verification on all forms to prevent automated abuse

You are responsible for all activities that occur under your account. Notify us immediately of any unauthorized use.

When you create an account, you are automatically subscribed to our mailing list to receive product updates, feature announcements, and Pro tier launch notifications. You can unsubscribe at any time.

4. Acceptable Use Policy

You agree NOT to use the Service to:

  • Monitor websites you do not own or have permission to monitor
  • Perform distributed denial-of-service (DDoS) attacks or other malicious activities
  • Monitor illegal or harmful content (phishing sites, malware distribution, illegal marketplaces, etc.)
  • Circumvent rate limits or service restrictions
  • Reverse engineer, decompile, or attempt to extract the source code of the Service
  • Resell or redistribute the Service without written permission
  • Interfere with or disrupt the Service or servers

Violation of this policy may result in immediate account suspension or termination.

5. Service Limitations

Free Tier Limits:

  • Maximum 1 website per account
  • Up to 10 HTTP monitors per website
  • 1 synthetic monitor per account
  • 1 AI analysis request per 20 minutes (to prevent service abuse during setup)
  • Check interval: Every 3 minutes for HTTP monitors, every 15 minutes for synthetic monitors
  • Data retention: 6 months

Pro Tier Limits (Coming Soon):

  • Maximum 3 websites per account
  • Unlimited HTTP monitors
  • 3 synthetic monitors per account
  • Check interval: Every 2 minutes for HTTP monitors, every 15 minutes for synthetic monitors
  • Data retention: 1 year

No Uptime Guarantee: While we strive for 99.9% uptime, the Service is provided "as is" with no uptime guarantees. We are not liable for missed alerts or monitoring downtime.

Check Accuracy: Monitoring checks are performed from our server location. Factors beyond our control (network issues, DNS problems, your website's hosting) may affect check accuracy.

6. Email Communications

By using the Service, you consent to receive:

  • Essential Service Emails: Downtime alerts, recovery notifications, password resets, email verification (cannot opt out)
  • Account Emails: Security alerts, Terms of Service updates, account notifications
  • Marketing Emails (optional): Product updates, feature announcements, Pro tier launch notifications, newsletter content. When you create an account, you are automatically subscribed but can unsubscribe at any time via the unsubscribe link in emails or by contacting us.

You may also subscribe to our mailing list without creating an account via our newsletter signup page. All marketing emails include an unsubscribe link.

7. Intellectual Property

Your Data: You retain all rights to your website URLs, monitoring data, and account information. By using the Service, you grant us permission to monitor your websites and store monitoring data for the purposes of providing the Service.

Our Property: The Service, including its source code, design, branding, and functionality, is owned by SiteStable and protected by copyright and intellectual property laws.

8. Data Retention and Deletion

  • Active Accounts: Your data is retained while your account is active
  • Account Deletion: You may delete your account at any time from your dashboard. All associated data (websites, monitors, check results, incidents, alerts) will be permanently deleted within 30 days.
  • Inactive Accounts: Accounts with no activity for 12+ months may be deleted with 30 days' email notice
  • Check Results: Automatically deleted after 6 months (free tier) or 1 year (pro tier)

9. Payment Terms (Pro Tier - Coming Soon)

When the Pro tier launches:

  • Subscriptions are billed monthly or annually in advance
  • All fees are non-refundable except as required by law
  • You may cancel your subscription at any time (service continues until end of billing period)
  • We reserve the right to change pricing with 30 days' notice
  • Failed payments may result in service suspension after 7 days

10. Service Modifications and Termination

Our Right to Modify: We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time with reasonable notice. We are not liable for any modification, suspension, or discontinuation.

Our Right to Terminate: We may terminate or suspend your account immediately, without prior notice, if you:

  • Violate these Terms of Service
  • Use the Service for illegal or malicious purposes
  • Abuse or attempt to circumvent service limits
  • Engage in behavior that harms the Service or other users

Your Right to Terminate: You may delete your account at any time from your dashboard.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • SiteStable SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION
  • WE ARE NOT RESPONSIBLE FOR MISSED ALERTS, MONITORING DOWNTIME, OR INACCURATE CHECK RESULTS
  • OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE LAST 12 MONTHS (OR $100 FOR FREE TIER USERS)
  • WE ARE NOT LIABLE FOR THIRD-PARTY SERVICES (EMAIL PROVIDERS, GOOGLE RECAPTCHA, YOUR WEBSITE HOSTING)

Service Provided "As Is": The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

12. Indemnification

You agree to indemnify, defend, and hold harmless SiteStable, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Monitoring websites you do not have permission to monitor

13. Dispute Resolution

Informal Resolution: If you have a dispute, please contact us first at support@sitestable.co so we can attempt to resolve it informally.

Governing Law: These Terms shall be governed by the laws of the United States without regard to conflict of law provisions.

Arbitration: Any disputes not resolved informally shall be resolved through binding arbitration in accordance with the American Arbitration Association's rules, rather than in court.

14. Changes to Terms

We may update these Terms from time to time. We will notify you of significant changes by:

  • Posting a notice on our website
  • Sending an email to your registered email address
  • Updating the "Last updated" date at the top of this page

Your continued use of the Service after changes constitutes acceptance of the updated Terms. If you do not agree to the new Terms, you must stop using the Service and delete your account.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and SiteStable regarding the use of the Service.
